Professional Motor Oy online store delivery terms

  1. Scope

These Professional Motor Oy e-commerce terms and conditions ("Terms") apply to the website www.professionalmotor.fi and the shop operated by Professional Motor Oy, as well as to orders and purchases of products from the e-commerce site. Professional Motor Ltd / myynti@professionalmotor.fi is the seller for all purchase transactions carried out in the online shop.

ORDERING PRODUCTS FROM THE ONLINE SHOP REQUIRES ACCEPTANCE OF THESE TERMS AND CONDITIONS.
By accepting these Terms and Conditions, you are also aware that we may send you email and/or text messages related to your order.

We reserve the right to update these Terms at any time. The updated Terms will apply to orders placed on or after the effective date of the new Terms. Nothing in these Terms shall limit the statutory rights of the consumer-customer.

  1. Ordering products and customer relationship

The online shop is open to both individuals and businesses of legal age. Products are ordered from the online shop by adding them to the shopping cart and making a payment. The ordering procedure allows you to check your order for errors before sending it. A contract is concluded between the customer and the seller when the seller confirms the order by e-mail.

When placing an order, the customer is required to provide (*) the following mandatory information:

The information of the e-shop customers is stored in the customer register of Professional Motor Oy's e-shop. Your personal data will be processed in accordance with the register's privacy policy, which can be found at: www.professionalmotor.fi

  1. Product range

Before ordering products, you should ensure that they are suitable for your intended use. You can use the product information in the online shop to make sure this is the case. If the content of the online shop differs from the information provided on another website or other source, the information provided in the online shop at the time of purchase will apply. The seller is not responsible for the suitability of the product for your particular intended use.

We may, at our discretion, update product descriptions at any time without prior notice. We reserve the right, without liability or prior notice, to suspend or discontinue the sale of any product.

  1. Pricing

The price charged for the product is the price indicated in the online shop at the time the order is placed. The price will be shown in your order summary before payment and will be confirmed in the order confirmation. If the price indicated in the Online Shop is incorrect due to an obvious typographical or other obvious error, the incorrect price shall not be binding on the Seller.

Käytettäessä mahdollista alennuskoodia, alennettu hinta näkyy tilauksesi koontitiedoissa ennen maksusuoritusta koodin syöttämisen jälkeen. Pidätämme oikeuden muuttaa verkkokaupassa ilmoitettuja hintoja ennalta ilmoittamatta. Muutettuja hintoja sovelletaan hinnanmuutoksen voimaantulon jälkeen tehtyihin tilauksiin.

The prices of the products in the online shop include VAT and other applicable taxes, but do not include delivery costs. Delivery charges will be shown in the assembly details of your order before payment is made. The delivery costs per order are displayed once the customer has selected the payment and delivery method for the shopping cart.

4.1 Runkopalautuksen hinnoittelu ja ehdot. Kyseessä on vaihto-osakauppa, jossa myyjä toimittaa asiakkaalle uuden tai korjatun tuotteen ja asiakas palauttaa myyjälle vastaavan tuotteen rungon. Tilatessasi tuotteitamme verkkokaupan kautta, hyväksyt, että ostamasi tuotteen hintaan voidaan lisätä jälkeenpäin runkoveloitus mikäli et palauta runkoa. Runkoveloituksen hinta on riippuvainen myytävästä tuotteesta. Hyväksymällä runkopalautuksen ehdot, sitoudut palauttamaan vastaavan tuotteen rungon myyjälle runkopalautuksena. Mikäli et palauta tuotteen, veloitamme sinulta runkoveloituksen. Runkoveloitus on aina tuotekohtainen, esimerkiksi ahtimissa 300€ (per ahdin) tai 900€ (kaksoisahtimet). Hyväksyt runkoveloituksen tuotetta tilatessasi verkkokaupasta. Et ole velvoitettu maksamaan runkoveloitusta, mikäli palautat tuotteen myyjälle toimituksessa annettujen ohjeiden mukaisesti.
Runkopalautuksen ehdot:

  • Tuotteen runko on palautettava viimeistään 30 vuorokauden sisällä tuotteiden vastaanottamisesta.
  • Runko palautetaan tilaamasi tuotteen mukana seuraavien ohjeiden mukaisesti, tuotteen myyntipakkauksessa.
    • Palautus on Suomessa veloitukseton runkopalautusohjeen mukaisella palautuskoodia käytettäessä.
  • Palautettavaan runkoon on siirrettävä tilaamassasi tuotteessa olevat kuljetustulpat ja suojat.
  • Palautettavan tuotteen tulee olla tilaamaasi tuotetta vastaava tuote. Esim. ahtimissa runko tulee olla samaa tyyppiä kuin tilattavassa tuotteessa.
  • Runkopalautuksen tuotteen on oltava kokonainen ja sisältää kaikki siihen kuuluvat osat (kuten liittimet, kulmanipat jne.
  • Runkopalautuksen tuote on korjattavissa. Esimerkiksi turboahtimien valuosissa (kuoret) ei saa olla vaurioita, halkeamia tai voimakasta korroosiota.
  • Runkopalautuksen tuotteessa on valmistajan tai alkuperäinen numero tallessa (esim. valmistajan kilpi tai muut tunnisteet).
  1. Payment methods and payment service providers

You can pay for your purchase in the ways specified in the online shop. Products and their delivery costs are paid at the time of ordering.

For an up-to-date list of available payment methods and their conditions, please visit the online shop. In connection with an invoice or instalment payment, the seller or its partners may obtain your credit information from a third party. The seller reserves the right not to offer all payment methods at all times or, alternatively, to suggest a change of payment method if for any reason your chosen payment method does not work when you complete your order.

  1. Deliveries

We deliver products from our online store to Finland and the European Union. We only deliver to home and business addresses. Poster restante addresses etc. are not possible for deliveries.

Orders are normally delivered within 2-5 working days of ordering. Please note that seasonal variations, public holidays and bank holidays may affect delivery times.

  1. Errors in products

If the customer is a consumer customer, we are liable for defects in the products we supply in accordance with Chapter 5 of the Consumer Protection Act. The Seller is not liable for defects caused by improper installation, handling, normal wear and tear or failure to follow the instructions for installation, use, maintenance or care of the product.

If you receive a product that is faulty, incorrect or missing products ordered, please contact our customer service as soon as possible after you discover the fault and no later than 14 days after receiving the delivery. However, the consumer-customer can always file a complaint within two months of the date on which the consumer-customer discovered the error.

If a product we have supplied is found to be defective, we will correct the defect, replace it with a non-defective product or, if the defect cannot be corrected or a non-defective product cannot be supplied, we will refund the proportion of the price corresponding to the defect without delay. We will compensate you for the defect in the product we sell, but not for consequential damages such as downtime, loss of earnings, travel expenses, freight, per diem, overtime or repairs. If a claim results in a return of the Products to us, we will be liable for the costs of such return.

  1. Right of withdrawal

We give you 14 days to exchange and return our products. If you return the order, we will refund the amount of the products and the shipping costs. We only accept returns of products purchased from the Professional Motor Ltd online store. This right of exchange and return does not limit the right of the consumer customer to cancel the distance contract by notifying the seller within 14 days of receipt of the product. Simply returning or not collecting the product is not sufficient and the customer must always submit a separate cancellation notice in accordance with our return policy to myynti@professionalmotor.fi. Please follow the detailed instructions for returning products at www.professionalmotor.fi.

If the customer cancels the transaction, he/she must return the product received without delay and no later than 14 days after the notification of cancellation. The return is free of charge for the customer if the order was placed from Finland. The customer is responsible for the return costs when the order was placed from outside Finland.

When a customer cancels an e-commerce order, the seller will refund the amount paid, including delivery costs, without delay and no later than 14 days after receiving the cancellation notice, using the payment method used by the customer in the original purchase transaction, unless otherwise expressly agreed with the customer. However, the seller is entitled to withhold the refund until he has received the goods back or until the consumer has provided proof that he has sent the goods back (e.g. with a return receipt).

The customer is responsible for the depreciation of the deployed product. The Seller shall be entitled to deduct from the amount to be refunded an amount corresponding to the depreciation of the product. If the product has become unsaleable after use, the seller may refuse to refund the amount paid by you in full. If the customer wants the product to be sent to him again, the customer will be responsible for the transport costs incurred.

  1. Overwhelming obstacle

The seller shall not be liable for any delay or damage caused by circumstances beyond the seller's control which the seller could not reasonably have foreseen at the time of the conclusion of the contract and the effects of which the seller could not reasonably have avoided or overcome. Examples of force majeure include trade war, armed conflict/actions of war, terrorist attacks, natural disasters, pandemics, industrial action, fires, cyber-attacks and failures in communication links. In the event of force majeure, the seller will notify the buyer at the beginning and end of the situation. The customer and the seller may terminate the order placed in the online shop with immediate effect if the force majeure has lasted for more than two (2) months.

  1. Limitations of liability

To the extent permitted by mandatory law, the seller's liability is limited to the tax-free price paid for the product purchased online and the seller is not liable for any indirect or other consequential damage. The limitations of liability shall not apply where the liability is based on intentional or grossly negligent acts or omissions on the part of the seller. The seller's liability for defects shall be limited to liability for defects under mandatory law. The seller does not provide any warranty or insurance beyond that required by mandatory law.

  1. Links to third party websites

The Online Store may contain links to third party websites or services. Even if a third party is affiliated with the Seller, we have no control over these linked sites or services, each of which has its own separate terms of use and/or privacy and data collection practices that are independent of the Seller. These linked websites and services are provided solely to support your use. You therefore use them at your own risk.

  1. Applicable law and dispute resolution

These Terms and Conditions, the Online Store and any purchase transactions made through the Online Store shall be governed by Finnish law, unless otherwise provided by mandatory law.

All disputes relating to these Terms, the Online Store and any purchase transactions made through the Online Store shall be resolved primarily through negotiation. If the dispute cannot be settled, the consumer-customer may contact the Consumer Helpdesk of the Competition and Consumer Authority (https://www.kkv.fi/kuluttajaneuvonta/) and then request the Consumer Disputes Board (www.kuluttajariita.fi ) to propose a solution.

The consumer-customer can also take the dispute to the Online Dispute Resolution forum at http://ec.europa.eu/odr. To resolve your dispute, please use our email address myynti@professionalmotor.fi.

The Customer also has the right to bring the dispute before the district court of the seller's domicile or, if the Customer is a consumer, the district court of the Customer's domicile or permanent place of residence.

  1. Other conditions

If any provision of the Terms is held by any court, authority or arbitration tribunal of competent jurisdiction to be invalid or unenforceable in whole or in part, the remainder of the provision and the other provisions shall remain in full force and effect and shall be enforceable. Any terms found to be invalid or unenforceable shall be replaced by valid and enforceable terms.
